Licence agreement
End user licence agreement (EULA) · version 2.5, 19 October 2026 · Deutsche Fassung
What this covers: this agreement governs what you may do with the software — client (viewer and host in one program), web viewer and relay. What applies when you use our service is in the terms of use; how we handle data is in the privacy notice; processing on your behalf is in the data processing agreement.
This version 2.5 replaces version 2.4 of 29 September 2026 for all agreements concluded on or after 19 October 2026. New: the two devices a relay keeps running with after the evaluation period without a licence are for private, non-commercial use only (section 5). Version 2.4 added online payment and creating Free yourself (section 6).
1Parties and contact
The licensor and your contact for this agreement is
(“we”). The licensee is you, the natural or legal person installing or using the software (“you”).
By installing or using the software you accept this agreement. If you do not accept it, do not install or use the software.
2Subject matter
Software under this agreement means the programs and components we provide:
- BrowserDesk Client — one program with two roles: it shares this computer (host) or controls another one (viewer), for Windows, Linux, macOS, iOS and Android;
- BrowserDesk Web Viewer — the viewer role in the browser;
- BrowserDesk Relay — the brokering service with web console, run by us or by you;
- the accompanying components (service, watchdog, native cores, scripts, packages and installers) and the documentation;
- later updates, unless those are expressly subject to their own terms.
The software is delivered as an executable, not as source code. There is no claim to release of the source code.
3Scope of the licence
We grant you a simple, non-exclusive, non-transferable right, limited to the term of the agreement, to use the software for your own purposes within the agreed scope. In particular you may:
- install it on any number of devices you own or administer;
- operate the relay on your own hardware or at a provider of your choice;
- make backup copies to the extent required for proper operation;
- let your staff and service providers acting for you use it — their acts count as yours.
If you provide IT services to third parties, you may use the software to support your customers. You remain responsible to us for compliance with this agreement.
4Licence, activation and periodic confirmation
The scope of your licence is set out in a licence file. Licences are issued by us through browserdesk.de only. A relay — including one you operate yourself — never issues licences, sub-licences or confirmations of its own; that is a security property of the software, not a malfunction.
On activation the licence is bound to one installation (installation identifier). Where the licence carries a check interval, the relay contacts our licensing service at that interval and has the binding confirmed anew. Only the licence file, the installation identifier and the machine name of the relay are transmitted. We gain no access to your systems, no content of your remote sessions and no inventory or usage data from your devices.
Where the licence permits it, confirmation may also take place offline: the relay produces a request code and we answer with an activation code. If confirmation is missing for longer than the check interval plus the grace period stored in the licence, the relay stops operating — no new registrations and no remote sessions until confirmation arrives. The same applies once the licence has expired plus the grace period stored in it. The software stays installed; your data is untouched.
Turning back the system clock, duplicating an activated installation and any other approach that circumvents a licence check is a breach of this agreement.
5Evaluation and feature trial
A relay without an activated licence runs in evaluation mode: 30 days from setup with up to five devices. Evaluation mode unlocks no add-on features. After the period the relay keeps running without a licence with up to two devices — the ones registered first — for private, non-commercial use only. Any business use after the period requires a licence.
In addition, each add-on feature under section 7 may be started explicitly for a feature trial of ten days, once per installation.
Evaluation mode and feature trials are provided free of charge; sections 14 and 15 apply to them with the statutory relief stated there. There is no claim to an extension or a repeat.
6Devices and sessions
Use of our service (browserdesk.de). The scope follows the form of use of your tenant:
- Cloud licence — what counts is the number of devices booked. Concurrent sessions and technicians are unlimited. Which features the paid cloud includes is stated in the service description on browserdesk.de; the version at the time of the order applies.
- Free (free use) — one concurrent session (a session is one remote session active at a given moment), a few devices and restricted features; the exact number of devices and the features are stated in the same service description. Every session must be confirmed on the device.
The service enforces these limits technically: once as many devices are registered as the cloud licence or Free includes, it rejects every further device; the devices registered first remain. When a booked term has expired, Free applies. Devices that have not joined a tenant run like Free, per device.
Your own relay. What counts is the number of devices stated in the licence file and its term. Concurrent sessions and technicians are unlimited. Without a licence, section 5 applies.
If you permanently need more devices than your cloud licence or licence file provides, book additional devices or extend the licence. Circumventing these limits technically — for instance through several relays, tenants or accounts for the same purpose — is a breach of this agreement.
Ordering and payment. An order placed on our website is your offer to us; the contract is concluded with our order confirmation in text form. The prices of the price list at the time of the order apply, net plus statutory VAT. Licences are invoiced in advance; you receive the licence file once payment has been received. A cloud licence runs for twelve months and is invoiced annually in advance; once payment has been received we activate the booked devices for your tenant. Our offer is directed at businesses, public authorities and associations.
Online payment. Where we offer online payment and you choose it, we forward you to our payment provider Stripe, where you see the total amount including VAT before paying. By way of derogation from the previous paragraph, the contract is concluded once the payment is confirmed; you then receive the order confirmation by email. The licence file or the activation of the booked devices follows without a separate invoice; if no tenant exists yet for a cloud licence, you receive a link to set it up.
Free. You create Free access yourself on browserdesk.de: you receive a link by email and use it to choose your tenant and your sign-in. There is one Free access per email address. Free is provided free of charge for private use and testing; sections 14 and 15 apply to it as they do to the trial.
7Add-on features
Individual features are licensed separately and can only be used with the corresponding feature signed into the licence:
| Feature | What it does |
|---|---|
| Extended inventory | periodic collection of device properties (hardware, operating system, software, security state, storage, network) and their evaluation in the console |
| Control centre | showing several computers at once as a matrix in the client, with handover into a controlling session |
Without the feature these functions stay switched off and the relay rejects the corresponding sessions. A visible menu entry grants no right of use.
8Limits
Without our prior consent in text form you may not:
- rent out, lend, sub-license or provide the software to third parties as a service of your own (no reselling as software as a service);
- pass licence files, activations or activation codes on to third parties;
- remove or alter manufacturer details, copyright notices or licence information;
- modify, reverse engineer, decompile or disassemble the software — statutory powers under sections 69d and 69e of the German Copyright Act remain unaffected;
- circumvent, disable or reproduce technical protection, licence or feature checks — in particular the periodic confirmation under section 4;
- publish performance data gathered without our involvement in a way that invites comparison with other products.
9Your duties when using the software
The software accesses other people's computers, shows screen content, moves mouse and keyboard, can reach computers unattended and after waking them, and — with the feature under section 7 — collect device properties and show several computers at once. Lawful use is your responsibility:
- Only your own devices, or with the consent of those entitled. Remote access without authorisation is prohibited.
- No covert surveillance. Unattended access, permanent sharing, the control centre and inventory collection all require that the people concerned have been informed. The control centre is not intended for monitoring performance or conduct.
- Employee data. If you use the software towards employees, ensure the necessary legal basis and involve the bodies of employee representation where required.
- Data protection. For the data collected with the software — in particular inventory data and session logs — you are the controller. If you run the relay yourself, that data stays with you; if you use our service, the data processing agreement applies in addition.
- Credentials. You keep device identifiers, passwords, accounts and licence files confidential and grant console permissions on a need-to-have basis.
- No misuse. No use for fraud or extortion, to circumvent third-party protection mechanisms, or for unlawful purposes.
Details are in section 4 of the terms of use, which form part of this agreement in that respect. You indemnify us against justified third-party claims arising from your breach of this section.
10Verification
On request you tell us in text form to what extent you use the software. Beyond the licence check under section 4 we do not carry out remote technical checks of your systems and do not require access to your installations.
11Updates
We provide updates through our feed. Client and service can download and install updates on their own; the running service is briefly restarted in the process. You can control the extent and the target version in the settings or in your console.
Security flaws are fixed in the current version only; you are expected to keep the software up to date. There is no claim to particular future features.
Updates may change or remove individual features where legal or security reasons require it. We point out material changes in the release notes.
12Third-party components
The software contains third-party components, some under free licences. For the component concerned its licence terms take precedence over this agreement; they may grant you broader rights. We provide an overview of components and their licences on request (info@browserdesk.de).
13Ownership
The software is protected by copyright. All rights in it, in its documentation and in marks such as “BrowserDesk” remain with us or our licensors. This agreement does not sell the software; it grants a right of use.
14Defects
Where the software is provided for a fee, we are liable for defects under statutory provisions. What matters is the agreed quality and otherwise its fitness for the contractually assumed use. We do not owe software free of all faults, but the remedy of material defects within a reasonable period — usually by providing a corrected version.
Where the software is provided free of charge (such as evaluation mode or a feature trial under section 5), section 523 of the German Civil Code applies: we are liable only for defects fraudulently concealed.
Claims for defects are excluded where a fault results from a change you made, from operation outside the documented requirements, or from third-party software. The relay stopping operation under section 4 is not a defect.
15Liability
We are liable without limitation for intent and gross negligence, for injury to life, body and health, under the German Product Liability Act and to the extent of any guarantee given.
In the case of slight negligence we are liable only for breach of a duty whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may rely; liability is then limited to the foreseeable damage typical of this type of contract. Any further liability is excluded.
For loss of data we are liable only to the extent that the loss would also have occurred had you made proper, regular backups. Where the software is provided free of charge, section 521 of the German Civil Code applies in addition.
Special note on the field of use: the software is not intended for operation in environments where a failure may lead to personal injury, severe environmental damage or comparable consequences (such as controlling medical devices, traffic systems or power plants). We accept no liability for such use.
16Term and end
The licence lasts for the term of the underlying agreement. It ends automatically when that agreement ends, and upon a material breach of sections 4, 6, 7, 8 or 9 after we have asked you to remedy it without success. You then stop using the software and delete the program files; you may keep backup copies where retention duties require it.
17Export control
The software is subject to European Union export law and possibly that of other states. You undertake not to make the software available in territories or to persons where applicable sanctions or export rules prohibit it.
18Final provisions
Changes to this agreement require text form. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the licensee is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Passau, Germany. Should any provision be invalid, the remainder stays in force and the statutory rule takes its place.
For consumers, mandatory statutory rights remain unaffected.
